eCommerce Terms & Conditions

General

This document is an offer by Pride and Joy to supply the products that are identified in this e-commerce transaction to the purchaser identified in this e-commerce document in accordance with these terms and conditions of sale, is not an acceptance or confirmation of any offer made by Purchaser, and is expressly made conditional on Purchaser’s assent to these Terms and Conditions.  Pride and Joy objects to any additional or different terms or conditions contained in any other document or communication previously or hereafter provided by Purchaser to Pride and Joy.  No such additional or different terms or conditions will be of any force or effect, unless specifically agreed to by an executive officer of Pride and Joy in writing.  These Terms and Conditions and the additional terms contained in this document, as supplemented by agreed-upon prices, quantities and shipping dates, shall be the entire agreement between Pride and Joy and Purchaser on the subject of the transactions described herein.

Shipping/Delivery Information

Products will be shipped by United States Postal Service to the requested delivery address.  Buyer is responsible for cost of return postage if delivery cannot be made.  No shipments to destinations outside the continental United States are authorized.  Pride and Joy guarantees no delivery dates, as such dates are estimates only, and reserves the right to make delivery in installments in order to fill an order.  Delay in delivery or any installment shall not relieve Purchaser of its obligations to accept remaining deliveries.  Pride and Joy shall not be liable for any losses or damages as a result of any delay or failure to deliver due to any cause beyond Pride and Joys’ reasonable control, including but not limited to any act of God, act of Purchaser, embargo or other governmental act, regulation or request, fire, flood, hurricane, accident, strike, slowdown, war, act of terrorism, delay in transportation, equipment failure, in inability to obtain necessary labor, materials or manufacturing facilities.  In the event of any such delay, the date of delivery shall be extended for a period equal to the time lost because of the delay.  Purchaser’s exclusive remedy for other delays and for Pride and Joys’ inability to deliver for any reason shall be rescission of the underlying order.

Refund/Return Policy

Pride and Joy warrants the Products manufactured by it or its affiliates and sold hereunder to be free from defects in material and workmanship for a period of up to two months after the date of delivery of the Product.  Performance representations (if any) are limited to those specifically included in Pride and Joys’ e-commerce site and identified as such.  Replacement or refund (whichever Pride and Joy determines, in its solediscretion, to provide) shall be Pride and Joys’ sole obligation and Purchaser’s exclusive remedy for any defect or deficiency in Products furnished hereunder, and shall be considered upon Purchaser’s return of the defective Product to Pride and Joy, if Pride and Joy requires such return. If the product needs to be returned because of not wanting duplicate or not fitting we need it back within six weeks of the day we mailed it out. 

Waiver

Pride and Joys’ failure at any time to enforce any of the provisions herein, or to require Purchaser’s performance of any of the provisions herein, shall not be construed to be a waiver of such provisions.
